Jane deals with all aspects of contentious insolvency and acts for office holders, creditors and debtors. She also acts extensively for directors in civil and regulatory claims.
As a commercial litigator she acts for financial institutions, companies and private individuals in a broad range of disputes including shareholder and partnership claims, property and trust matters and contractual disputes of all kinds.
Jane has taken the following cases to the Court of Appeal, the latter three being successful:
- Official Receiver v Stern & Anor  EWCA Civ 111 – whether, in disqualification proceedings, information obtained under compulsion infringed a defendant’s privilege against self-incrimination and whether the “inequality of arms” in disqualification proceedings was a breach of Article 6 of the European Convention on Human Rights.
- Smithton Limited v Naggar  EWCA Civ 939 – a joint venture dispute that considered a wide range of issues including whether a director of the holding company of a group of companies has become a director of its subsidiary and what makes a person a de facto director
- Burrows Investments Ltd v Ward Homes Ltd  EWCA Civ 1577 – a property claim that considered issues of contractual construction and whether breach of a negative restrictive covenant entitled the innocent party (who had suffered no loss) to negotiating damages
- Ong & others v Ping  EWCA Civ 2069 – a cross-border trust dispute over a substantial Hampstead property between a British wife and the estate of the widow of a Singapore banking tycoon. At the heart of the case was whether the property was subject to a trust and the components of an express declaration of trust.
